We provide a platform for businesses to list their services. We are NOT involved in transactions between buyers and sellers.

User Responsibility

Users are responsible for their own actions, content, and transactions. Verify businesses before making purchases.

Kenyan Law

These terms are governed by Kenyan law. Disputes resolved in Kenyan courts.

1. Acceptance of Terms

By accessing or using the biz yangu hub platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Important Notice

These Terms constitute a legally binding agreement between you and biz yangu hub Limited. By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Who Can Use Our Service

  • You must be at least 18 years old to create an account
  • You must be legally capable of entering into binding contracts
  • You must provide accurate and truthful information
  • You must comply with all applicable laws and regulations
  • Business owners must have legal authority to represent their business

2. Description of Service

What We Provide

biz yangu hub is an online business directory and listing service that enables:

  • Businesses to create profiles and showcase their products/services
  • Customers to discover and contact local businesses
  • Communication tools to facilitate business-customer interactions
  • Business management tools and analytics for listed businesses
  • Review and rating systems for customer feedback

Critical Disclaimer - What We DO NOT Do

  • We DO NOT sell products or services - We are a listing platform only
  • We DO NOT process payments between buyers and sellers
  • We DO NOT guarantee the quality, safety, or legality of listed items or services
  • We DO NOT verify the accuracy of all business information
  • We DO NOT act as intermediaries in disputes between businesses and customers
  • We DO NOT provide warranties for any products or services listed

All transactions are directly between businesses and customers. Use caution and verify businesses before making purchases.

3. User Accounts and Registration

Account Creation

To use certain features of our Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

Business Verification

For business accounts, we may require additional verification:

  • Valid business registration documents
  • Proof of physical business address
  • Valid contact information verification
  • Tax compliance certificates (where applicable)

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We recommend using strong passwords and enabling two-factor authentication when available.

4. Acceptable Use and User Conduct

Permitted Uses

  • List legitimate businesses and services
  • Search for and contact local businesses
  • Leave honest reviews and ratings
  • Use our tools for legitimate business promotion
  • Communicate respectfully with other users

Prohibited Activities

You agree NOT to use our Service for any of the following:

Illegal Activities

  • Fraud or misrepresentation
  • Money laundering
  • Sale of illegal goods/services
  • Copyright infringement
  • Violation of any laws

Harmful Behavior

  • Harassment or bullying
  • Hate speech or discrimination
  • Spam or unwanted communications
  • False reviews or ratings
  • Identity theft

Technical Abuse

  • Hacking or unauthorized access attempts
  • Introducing malware or viruses
  • Overwhelming our servers (DDoS attacks)
  • Scraping or automated data collection
  • Reverse engineering our platform

Enforcement

We reserve the right to investigate violations, remove content, suspend or terminate accounts, and cooperate with law enforcement. Repeated violations may result in permanent bans.

5. Content and Intellectual Property

Your Content

You retain ownership of content you post ("User Content"), but you grant us certain rights:

  • Right to display your content on our platform
  • Right to distribute your content to platform users
  • Right to modify content for technical compatibility
  • Right to use content for promotional purposes (with attribution)

Content Standards

You warrant that your content is accurate, non-infringing, and complies with all applicable laws. You're responsible for ensuring you have rights to post all content.

Our Intellectual Property

The biz yangu hub platform, including our logo, design, features, and software, is our intellectual property:

  • Protected by copyright, trademark, and other laws
  • You may use our platform as intended but may not copy, modify, or distribute our code
  • Our trademarks and logos may not be used without written permission
  • Any unauthorized use may result in legal action

Copyright Complaints

If you believe content on our platform infringes your copyright, contact us at legal@bizyangu-hub.co.ke with details of the alleged infringement. We respond to valid DMCA takedown notices.

6. Payments and Subscriptions

Pricing and Payment Terms

  • All prices are in Kenyan Shillings (KSh) and include applicable taxes
  • Payment is required before service activation
  • We accept M-Pesa, bank transfers, and major credit/debit cards
  • Subscription fees are billed monthly or annually as selected
  • Failed payments may result in service suspension

Critical Payment Timelines - Automated Processes

The following are AUTOMATED processes that apply to all accounts. Intervention is only possible by settling outstanding obligations:

New Business Profile Creation

  • Initial Grace Period: Upon profile creation, you have 7 days to remit the registration fee
  • Conditional Activation: We may activate your profile upon request for 48 hours to allow you to set up while awaiting payment
  • Automatic Suspension: If payment is not received within 48 hours of conditional activation, your profile will be automatically suspended
  • Extended Grace Period: After suspension, you have an additional 5 days to complete payment (total 7 days from initial creation)
  • PERMANENT DELETION: If registration fee is not paid within 7 days of profile creation, your business profile will be permanently deleted with no option for recovery

Subscription Payment Delays

  • Active Grace Period: Account remains fully active for 7 days after subscription payment is due
  • Automatic Suspension: After 7 days of non-payment, your account will be automatically suspended
  • Limited Access: During suspension, you cannot access your dashboard or receive customer inquiries, but your data is retained

Data Retention During Suspension (Established Accounts)

  • Eligibility: Accounts that have been actively used for more than 6 months qualify for extended data retention
  • Retention Period: Upon suspension, your data will be retained for 45 days awaiting reactivation
  • Billing During Suspension: Data retention is a billable service. When you reactivate, you MUST settle:
    • All subscription fees for the months during suspension
    • Any outstanding balances from before suspension
    • Current month's subscription fee
  • Example: If suspended for 2 months, reactivation requires payment for those 2 months plus the current month
  • Permanent Deletion: After 45 days of suspension without payment, all data will be permanently deleted

Automated System Notice

All suspension and deletion processes are fully automated and cannot be reversed or delayed without payment settlement. We strongly recommend setting up automatic payment reminders and ensuring sufficient funds are available before due dates. Our support team can only assist with payment processing but cannot override automated suspension or deletion timelines.

Subscription Management

Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. You can manage renewals in your account dashboard.

Cancellation

Cancel anytime through your dashboard or by contacting support. No refund for unused portion of current billing period.

Refund Policy

  • 15-day money-back guarantee for new customers (first subscription only)
  • Refunds processed within 7-10 business days to original payment method
  • No refunds for services already consumed or after 15 days
  • Account termination required for refund processing

Payment Disputes

Contact us before disputing charges with your bank. Unauthorized disputes may result in account suspension and additional fees to recover costs.

7. Limitation of Liability

Important Legal Protection

TO THE MAXIMUM EXTENT PERMITTED BY KENYAN LAW, biz yangu hub SHALL NOT BE LIABLE FOR:

  • Any transactions or interactions between businesses and customers.
  • Quality, safety, legality, or availability of products/services listed.
  • Actions or omissions of businesses or customers using our platform.
  • Financial losses, loss of goods, data, or business opportunities.
  • Indirect, incidental, punitive, or consequential damages.
  • Service interruptions, technical issues, or data loss resulting from external factors, third-party services, or circumstances beyond our reasonable control.
  • Unauthorized account access resulting from:
    • Compromised user devices or systems.
    • Exposed or shared user credentials.
    • Phishing attacks targeting users.
    • Failure to maintain adequate security on user-controlled equipment.
    • Any security breach originating from the user's side of the security boundary.

Liability Cap

In any event, our total liability to you shall not exceed the amount you paid us in the 6 months preceding the incident giving rise to liability.

Service Reliability

Biz Yangu Hub is hosted on Google Cloud infrastructure, offering enterprise-grade reliability with a 99.999% uptime SLA. We continuously monitor and maintain our systems to ensure smooth and secure access to our services. Please note that actual performance and accessibility may vary depending on the quality and stability of your internet connection or other network conditions beyond our control.

8. User Indemnification

You agree to indemnify, defend, and hold harmless biz yangu hub, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from:

  • Your use of our platform and services
  • Your violation of these Terms of Service
  • Your violation of any law or regulation
  • Content you post or share on our platform
  • Your business operations and customer interactions
  • Any transactions between you and other users

Mutual Protection

This indemnification is mutual protection. Just as you protect us from claims arising from your actions, we work to provide a secure platform and will assist in defending legitimate use of our service.

9. Termination

Termination by You

You may terminate your account at any time through your dashboard or by contacting us. Upon termination:

  • Your business listings will be removed from public view
  • Access to premium features will cease
  • Account data will be retained as per our Privacy Policy
  • No refund for unused subscription periods (except during guarantee period)

Termination by Us

We may suspend or terminate your account immediately if:

Immediate Termination

  • Violation of Terms of Service
  • Illegal activities
  • Fraud or misrepresentation
  • Harassment of users/staff
  • Security violations

With Notice

  • Non-payment of fees
  • Inactive accounts (45 days)
  • Business closure
  • Service discontinuation
  • Legal requirements

Account Reinstatement

Suspended accounts may be reinstated upon resolution of issues and payment of any outstanding fees. Terminated accounts for serious violations cannot be reinstated.

10. Dispute Resolution

Informal Resolution

Before initiating formal proceedings, we encourage you to contact us to resolve disputes informally:

Governing Law and Jurisdiction

  • These Terms are governed by the laws of Kenya
  • Any disputes shall be resolved in the courts of Kenya
  • Nairobi courts shall have jurisdiction for all proceedings
  • English language version of these Terms shall prevail in case of translations

Alternative Dispute Resolution

For disputes under KSh 100,000, we may agree to binding arbitration through the Chartered Institute of Arbitrators (Kenya). This can be faster and more cost-effective than court proceedings.

11. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices.

Material Changes

For significant changes affecting your rights or obligations, we'll provide at least 30 days' notice via email and prominent platform notices.

Minor Updates

Minor changes (corrections, clarifications) will be posted with an updated "Last Modified" date at the top of these Terms.

Your Options

If you don't agree with changes, you may terminate your account before the changes take effect. Continued use after changes become effective means you accept the updated Terms.

12. General Provisions

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and biz yangu hub.

No Waiver

Our failure to enforce any provision doesn't waive our right to enforce it later. All rights are reserved.

Assignment

We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights without our consent.

Force Majeure

We're not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, internet failures, or other force majeure events.
